THE ALTERNATIVE DISPUTE RESOLUTION PROCEDURES (A.D.R. PROCEDURES)

 

The ADR are  ways of managing  conflict which are different from the Courts of law have or use..

Some authors consider that the procedures should be called `suitable` and not ´alternative´ since each conflict can have a proper way to solve.

 -The ADR procedures arises in the industrialist scope where people look for a more economical  system than litigation  to solve their conflicts. They also look for faster and better ways to solve conflict avoiding  ´all or  nothing´ solutions and  to maintein the control  on the result.

 

THE MOST COMMON ADR PROCEDURES IN OUR COUNTRY ARE:

NEGOTIATION:  Two or more people who have a conflict  try to solve their differences .

 

MEDIATION: Mediation is a procedure  in which  a third neutral party (mediator) helps people to develop a constructive process for parties to work out their differences by themselves. The mediator does not decide a solution.

 

ARBITRATION:  A neutral third party decides the solution.
